( 2 ) Our purposes:

In order to meet the purpose of our contract with you, such as finding copyright infringements, preparing the cases, and handing them over to our lawyer network, for which you had given us the permission before and/or signed a “Power of Attorney” first, settle your cases and transfer your money, we may need to obtain some of your personal data. This may include, for example, your email address, personal address, name, surname, your website, taxation number, ID card number and bank transfer data. The only parties your data may be shared with are our affiliates and exclusively under the premise that you have given us consent to do so first.

If we would not be able to store and use your personal data stated above, eventually we would not be able to comply with our purpose for you, which is stated in detail in our Terms & Conditions.

To deliver you messages connected to the protection of copyright law in photography, we are also storing the data, which you have provided us during the application process, for example, your photography type.

We are also tracking link opens and clicks in the automated messages to estimate how relevant they are for you and improve our marketing strategies for the future.

In any moment, you can unsubscribe from our newsletter or edit/remove this data by clicking the buttons “Unsubscribe from this list” or “Update your preferences”. You will find these buttons in each of our newsletters in the footer. If you unsubscribe from the newsletter, you remain PhotoClaim’s client. Then, you will only receive emails regarding our Terms & Conditions and our Privacy Policy, unless you specify otherwise.

 

( 3 ) Consent – the lawful basis for the processing:

PhotoClaim Sp.z o.o. collects and processes your data only under your consent, understood as ‘a explicit affirmative action, which signifies an agreement to personal data being processed. We ask you for permission during the registration process and separately for contractual (expressed in our Terms & Conditions) and marketing purposes.

Of course, you have a right to withdraw your consent at any time via postal mail or via email, as stated above.

 

( 4 ) Your individual rights as the personal data owner.

Under GDPR regulations, you have a right:

  • to be informed about and get access to your data
  • to object to processing that – in your opinion – is likely to cause or is causing damage or distress
  • to prevent processing for direct marketing
  • to object to decisions being taken by automated means
  • in certain circumstances, to have inaccurate personal data rectified, blocked, erased or destroyed (‘to be forgotten’)
  • to claim compensation for damages caused by a breach of the GDPR Act

 

( 5 ) Our affiliates – are the recipients of your personal data.

 Our affiliates – lawyers for which you have given us permission to hand over cases to, PhotoClaim GmbH and RightsPilot UG who are using these data to process copyright matter, as well as trusted external services and software in order to comply with fulfilling our service and based on 6 Abs. 1 S. 1 lit. b DSGVO.

 

( 6 ) The retention periods for the personal data.

We are storing and processing a client’s data until the termination of our contract is finalised. That means until all pending cases which PhotoClaim is conducting are settled or closed and that all legally necessary billing procedures are finalised (Art. 5 para. 1 lit. e GDPR)

 

( 7 ) The right to lodge a complaint with the supervisory authority.
