Every single day we go through thousands of findings, dig deeper and deeper and it is not only the infringements of copyright that we find but also a lot of bad publicity. Oh, we know what we are talking about, we have been there many times! One of the tools which we use in our negotiations, called Cease & Desist Letter (aka Abmahnung), is often perceived not as a friendly one but rather as a dangerous warning. We identified that Cease & Desist Letter (aka Abmahnung) can make infringers very frustrated. In response, some of them spread unfair articles, references or other written pieces which mention photographers’ and lawyers’ names or services but were obviously not authorized by them.
You are protected by law
Such practises are highly restricted by law. EU data protection rules, also known as the EU General Data Protection Regulation (or GDPR), guarantee the protection of your personal data whenever they are collected. ”It doesn’t matter what format the data takes – online on a computer system or on paper in a structured file – whenever information directly or indirectly identifying you as an individual is stored or processed, your data protection rights have to be respected.” As of yet, the United States does not have any centralized, formal legislation at the federal level regarding this issue. But still, the privacy and protection of data are insured through the United States Privacy Act, the Safe Harbor Act and the Health Insurance Portability and Accountability Act.
