No. Since our cooperation is mostly email-based, as long as you have Internet access, your place of residence doesn’t matter.
The cases are first started through a German lawyer. A lawyer operating in the country where the infringement took place will be involved once you decide you want to take the case to court or if the out-of-court negotiation through the German lawyer turned out unsuccessful.
We operate based on the “No win, no fee” rule. You don’t pay us anything for monitoring your portfolio. Only when we are able to get you the money you deserve, we will take a fair share of the recouped damages. If we are able to get an out-of-court settlement, you will receive 55% of the paid damages.
You don’t have to, we are taking care of that through an authorised service. Preparing the evidence documentation does not imply any extra costs for our clients.
The amount of money is calculated in accordance with German Mittelstandsgemeinschaft Foto-Marketing (MFM) pricing. It depends on the number, type of photos, and period for which infringement was publicly available. The final reimbursement is also dependent on the way in which the photos were used.
However, if you have your own prices that can be proved with licensing invoices, we can apply those for you.
